Event Description

Buying tax delinquent property at a Pennsylvania “tax sale” can be a great way to get property for a very low price, often just the unpaid property tax bills and sale expenses. But the rules in Pennsylvania are different from any other state, and are a confusing mess for the uninitiated. ACRE’s board member and general counsel, Attorney  Brad Dornish has represented buyers and owners involved in every type of sale, written training materials for and taught real estate lawyers, brokers, agents and investors the ins and outs of the sales for many years. He is offering a new, all day seminar just for investors to review what you need to know about these sales before you buy, and how you can navigate the tax sale processes.  


There are ten different types of real estate tax sales in Pennsylvania. In counties other than Allegheny and Philadelphia, Tax Claim Bureaus handle most, but not all tax sales. There are four different types of sales conducted by Tax Claim Bureaus alone, including Upset Sales, Judicial Sales, Private Sales and Repository Sales. Each has different procedures, and whether the title obtained is clear depends on both the type of sale and the notices sent before the sale.


In Allegheny County, there is no Tax Claim Bureau, but the Pittsburgh City Treasurer sells tax delinquent properties under a separate Treasurer’s Sale Law, and has at least four different types of sales, including Upset Sales and Judicial Sales under different rules than the Tax Claim Bureaus, and its own unique Side Yard Sales and Make Us an Offer Sales. Outside Pittsburgh, the rest of Allegheny County is stuck with old fashioned sheriff’s sales for unpaid taxes, which occur property by property, at the same times as and mixed in with mortgage foreclosure sales. There are Upset Sales and Judicial Sales under this process, too, but under a different set of rules.


Some types of tax sales are subject to redemption of the property by the prior owner after the sale, many sales are subject to redemption by the IRS, and when proper notices have not been served, sales can be set aside, or properties sold free and clear can still be subject to liens.
